A Lawsuit Challenges The Constitutionality Of Denver's Pit Bull Ban

A lawsuit has been filed in federal court in Denver that challenges the Denver pit bull ban. Denver bans pit bulls defined as â€œany dog that is an American Pit Bull Terrier, American Staffordshire Terrier, Staffordshire Bull Terrier, or any dog displaying the majority of physical traitsâ€ of these breeds. Denver Mun. Code Â§8-55 The ordinance makes it unlawful to â€œown, possess, keep, exercise control over, maintain, harbor, transport, or sellâ€ any pit bull dog within the city. Denver Mun. Georgia Judge Finds Dept. Of Agriculture Is Violating The Law By Allowing Animal Gas Chambers

Fulton County Superior Court Judge Cynthia D. Wright ordered the Georgia Department of Agriculture to enforce the 1990 Georgia Humane Euthanasia Act which with few exceptions bans the use of carbon monoxide gas chambers to euthanize animals. The ruling was the result of a motion for a preliminary injunction in a lawsuit brought against the Department and its Commissioner Tommy Irvin, whom the judge noted had violated the law by permitting shelters, with "a wink and a nod," to gas animals to death for the past 17 years.
