VA Bill Would Increase Animal Abuse Penalties, Limit Abusers' Access to Animals

Update: The bill, H.B. 281, is now law. As passed, the law increases the penalty for a second or subsequent violation of the animal care laws regarding an owner's failure to provide adequate food, adequate water, adequate shelter, and adequate veterinary care from a Class 4 to a Class 2 misdemeanor. Penalties for a second or subsequent violation related to adequate space, adequate exercise, and adequate care, treatment and transportation are increased from a Class 4 to a Class 3 misdemeanor.

Oklahoma Rep. Jerry McPeak has introduced this bill, H.B. 2758, that would allow a tax credit up to 50% for construction, refurbishment or conversion of a qualified horse slaughter facility in the state. A qualified horse slaughter facility is one that is constructed, refurbished or converted after January 1, 2012 in Oklahoma.

Under current Virginia law, persons caring for dogs must provide "adequate space" and when it comes to tethered companion animals, "adequate space""means sufficient space to allow each animal to: (i) easily stand, sit, lie, turn about, and make all other normal body movements in a comfortable, normal position for the animal; and (ii) interact safely with other animals in the enclosure."

Update Jan. 19, 2012: New Hampshire H.B. 1446 has now been introduced to make clear the meat inspection program enacted last year excludes equines. The failure to exclude equines was an oversight, according to the sponsors, New Hampshire state Reps, Laurie Harding and Tara Sad. H.B. 1446 is pending before the state Environmental and Agriculture Committee of the House of Representatives.

S.B. 288 introduced in the Florida senate by state Sen. Mike Fasano would redefine "domestic violence" to include infliction or attempts to inflict physical injury on an animal belonging or in the care of a family or household member and also acts that place a family household member in fear that harm will be done to an animal in their care. The bill would allow judges to issue orders of protection in favor of such animals.

Pennsylvania Senate Bill 71 would make it a crime not only to conduct greyhound races for public exhibition but also "transmit or receive interstate or intrastate simulcasting of greyhound" races for "monetary remuneration".

Update June 11, 2011: S.B. 223 has now been signed into law by Nevada Gov. Brian Sandoval. The bill was approved by the Senate and the Assembly by overwhelming margins. The new law is called Cooney's Law, after Cooney, a dog Raymond Rios adopted from a shelter and then tortured to death with a box cutter. He subsequently pleaded guilty to the misdemeanor animal cruelty charge, the most severe crime he could be charged with, paid the $640 fine and was released with jail time served.

H.B. 963 has passed the legislature and has been sent to Gov. Rick Perry for signature. This bill makes appeals to a county court de novo in cases where an animal is taken from an owner convicted of cruel treatment, meaning the court must consider the case as if no decision had been made by a lower court. The defendant would have a right to a jury trial.

The bill would also require a cash or surety bond to be posted to cover the costs of caring for animals held pending an appeal.

Connecticut H.B. 6226 would require state, regional, and municipal animal control officers (ACOs) and Department of Children and Families (DCF) employees to report to the Department of Agriculture (DOAG) commissioner when they reasonably suspect that an animal is being treated cruelly, harmed, or neglected. The agriculture commissioner would then be required to forward the information to the DCF commissioner in a monthly report.
